The following Terms of Use govern the use of the websites (hereinafter referred to as “Site”). By accessing this Site and using the services you agree to be bound to these Terms of Use. If you disagree with the Terms of Use or parts of it, you may not use this Site.

These Terms of Use may in individual cases be supplemented, modified or replaced by further specif-ic terms and conditions of FANUC, in particular with respect to the offer of products and/or services.

1. Copyright and Rights of Use

The content and structure of the Site are protected by copyright. This applies to both the structure of the Site and to any and all functionalities, information, data, text, pictures, and sound materials which are contained on the Site and also to all components which are used to ensure that the pages of the Site are functional. Unless the user uses extended services which are governed by special conditions, the information and contents may be used within the limits as defined by the functions offered on the Site. In the event that any content of the Site is accessible for download or print, FANUC grants the user a non-exclusive, non-transferable, limited right for personal and non-commercial use. This right does not allow the user to make any commercial use of the content of the Site, but the user shall use the content to make commercial decision, such as to enter into negotiations with FANUC regarding FANUC’s products advertised on the Site. In all other respects, the user shall not acquire any rights in or to the content, materials, programs, and components of the Site, unless otherwise authorized by FANUC. In particular, the user
a) shall not, modify, remove copyright and other proprietary notices contained in the content;
b) shall not modify the content in any way or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose;
c) shall not transfer the content to any other third party;
d) shall not use this Site in any way that causes, or may cause, damage to the Site or impairment of the availability or accessibility of the Site; or in any way which is unlawful, fraudulent, illegal or harmful etc. or in connection with such purpose or activity.

2. Trademarks and Logos

The trademarks and logos used on the Site are legally protected. It is therefore not allowed to use such trademarks and logos without the prior consent of the respective holder of the rights.

3. Responsibility for Information and Contents, Availability

Unless otherwise explicitly stated, the information and contents provided do not constitute a binding offer by FANUC to enter into a contract. Consequently, any description of products or services shall not be understood as an offer which may be accepted in a way automatically giving rise to contractu-al obligations.
By displaying information FANUC does not provide advice and also does not recommend or request that a particular product or service should be purchased. The only purpose of the information pro-vided is to help users make their own independent decisions as to whether a particular product or service is fit for a particular purpose.

The Site and the retrievable information and contents are compiled carefully. FANUC aims to ensure that all information and contents provided by the Site are up to date and correct. However, it cannot be completely excluded that the provided information and contents are incorrect or do not represent the current state. Therefore, FANUC is not responsible for the timeliness, accuracy or completeness of the information and contents provided within the Site, particular with regard to price or product information. Also, FANUC does not assume any warranty that the content and information are free from defects or are suitable for any particular purpose. Any reliance on any such opinion, advice, statement, memorandum, or information shall be at your sole risk.

FEC does not warrant that the services from the Site will be uninterrupted, timely or error-free, alt-hough it is provided to the best ability.

4. Hyperlinks and Third Party Websites

As a convenience to you, FANUC may provide links to websites operated by third parties (such as Youtube, Twitter and Facebook). All these links were thoroughly examined by us before they were activated. However, we cannot rule out that the relevant suppliers may make subsequent changes to the content, which is why we cannot accept liability for the content of the linked websites of other suppliers. In particular, we do not warrant that the content of such websites is up to date, correct, and complete. If you decide to visit any linked website, you do so at your own risk and it is your re-sponsibility to take all protective measures to guard against viruses or other destructive elements.
However, please notify FANUC immediately in the event that you detect illegal, inappropriate or in-correct information or contents within the linked websites.
FANUC makes no warranty or representation regarding, and does not endorse, any linked websites or the information appearing thereon or any of the products or services described thereon. Links do not imply that FANUC or this Site sponsors, endorses, is affiliated or associated with, or is legally au-thorized to use any trademark, trade name, logo or copyright symbol displayed in or accessible through the links, or that any linked website is authorized to use any trademark, trade name, logo or copyright symbol of FANUC or any of its affiliates or subsidiaries.
Creating frame or inline links from other websites to the Site without prior written consent of FANUC is expressly forbidden. In particular, you are not permitted to use a hyperlink to include or display the Sites or its respective content in a frame.

5. Information Provided By You

FANUC does not want you to, and you should not, send any confidential or proprietary information to FANUC via the Site. You agree that any information or materials that you or individuals acting on your behalf provide to FANUC will not be considered confidential or proprietary. By providing any such information or materials to FANUC, you grant to FANUC an unrestricted, irrevocable, world-wide, royalty-free license to use, reproduce, display, publicly perform, transmit, change and distrib-ute such information and materials, and you further agree that FANUC is free to use any ideas, con-cepts or know-how that you or individuals acting on your behalf provide to FANUC. You further rec-ognize that FANUC does not want you to, and you warrant that you shall not, provide any information or materials to FANUC that is defamatory, threatening, obscene, harassing, or otherwise unlawful, or that incorporates the proprietary material of another. FANUC reserves the right to remove such content from the Site.

6. Limitation of Liability

FANUC shall be liable for bodily injury, for damages or losses caused by willful misconduct or gross negligence. Any further liability of FANUC, especially, but not limited to liability for damages or losses caused by slight negligence, shall be excluded to the maximum extent allowed under the applicable statutory regulations.
Notwithstanding the preceding provisions any contributory negligence of the user – in particular the lack of provision of cooperation services, organizational errors, inadequate data backup or a violation of other contractual obligations – reduces the amount of any claim for damages.

7. Changes

FANUC may terminate, change, suspend or discontinue any aspect of the Website, including the availability of any features of the Website, at any time. FANUC may also impose limits on certain fea-tures and services or restrict your access to the Site without notice.
FANUC reserves the right to change these Terms of Use from time to time as it sees fit. Your contin-ued use of the Site will signify your acceptance of any adjustment of these Terms of Use.

8. Governing Law

The Site is operated under the law of Luxembourg.
